Kaishi Travel Terms and Conditions

KAISHI TRAVEL OPERADORA DE TURISMO, with RNT No.8936 of the Ministry of Commerce, Industry and Tourism, is fully responsible for the quality of products and services described in their programs in accordance with the provisions of Law 300 of 1996, Decree 1075 / 97, the Liability Clause of the Decree 2438/2010 and the rules that modify, add or amend it. Rates are subject to change and availability without previous notice. As established by law in 1480 of 2011 and on the Article 47 of Decree 1499 of 2014, the user may use the right of retract faculty as long as the purchase has been done by non-traditional methods. For cases where this right is used, KAISHI TRAVEL OPRERADORA DE TURISMO, will process the refund with the hotel or supplier, as long as the client makes use of this right within the next 5 business days to the purchase as required by law, taking in consideration that if the services are going to be used within that 5 business days, the user can not apply for a refund, and therefore, KAISHI TRAVEL OPERADORA DE TURISMO will apply all penalties or discounts which are set by the supplier. The products and services purchased are to be settled using the TRM (exchange rate) of the day of payment. Rates may vary depending on availability or established valid periods. Restrictions and conditions for each rate published by according to their validity.

Prices only include services indicated in the published plan. Either Local National or Foreign Regulators may do additional charges. The services included in the travel plan are subject to the terms of the plan. Accommodation will be only confirmed once the payment is received, in accordance with the terms and conditions established by ground service providers that are part of the chosen travel plan.

Prices of plans offered or published at the time of listing, are subject to change without notice. Valid prices honored will be the ones valid at the time confirmation of the purchase and payment of the travel plan.

Quotations generated in the system show availability and prices ​​at the time of issue. They are NOT confirmation of hotel space or selected tours, therefore availability is not guaranteed on the quoted property nor hotel rates as reservation and confirmation of services will be done after the payment is received.
With the promulgation of Law 1581 of 2012 and Decree 1377 of 2013, about Data Protection Policy, which develops the constitutional right of all people to know, update and rectify any information collected or that has been subject to the processing of personal data used by banks, databases or in any type of files public and / or private entities. To comply with the provisions of this regulation, KAISHI TRAVEL OPERADORA DE TURISMO is responsible for processing of personal data obtained through its various sales and contact channels, will ask all clients, users in general and any other individuals whose personal information rests on KAISHI’S TRAVEL OPERADORA DE TURISMO databases, the authorization to continue processing of personal data according to the Privacy Policies available.

The information and personal data supplied by you, may be used by KAISHI TRAVEL, for purposes of developing its own service functions, send information and advertising of products and / or services available, and deliver reports to the authorities of surveillance and control.

General Conditions

  • Fares valid until January 15, 2017.
  • Fares and itineraries subject to availability and changes without notice.
  • With the application of the reservation, the passenger or his representative accepts the conditions of each program, including advance payments and cancellation policies and agrees to accept all the requirements made before the trip, as well as the comments by guides and agency officials and their operators made at the beginning and during the trip.
  • Booking travel to participate in any of these general conditions implies that nothing should be understood or imagined to be included if it is not described in the programs.        
  • All passengers must carry with them all the required personal documentation, as well as medicines and personal items.
  • Traveler should comply with all legal, moral, discipline and baggage standards and will be fully responsible for any objects carried.
  • Cancellation of land portions should be done at least one week before starting the trip, except in those cases the operator, with prior notice, specify different terms. Non used services value, after discounting penalties, administration expenses, no shows and other expenses and taxes caused in accordance to the agency and service providers will be reimbursed.

KAISHI TRAVEL, Tour Operator with National Tourism Registry No. 8936, is cover by the liability clause established in Article 3 of Decree 053 of January 18, 2002 and subsequent amendments

  • KAISHI TRAVEL, Tour Operator, will be responsible for the proper provision and quality of the services specified in the tours described in their catalogs and / or website, limiting its liability for events such as accidents, strikes, riots, earthquakes and other force majeure cases may occur during the trip.
  • Traveler is not entitled, if he/she needs to cancel or interrupt the trip due to force majeure once started, to the refund of any the amount corresponding to the services not used in accordance with the policies of each service provider.
  • Should any reimbursement is authorized, values are specified in the previous item, will be delivered or deposited into passenger’s account or any specified agency acting on its behalf, within 20 business days from the date of receipt of the request..
  • In case of cancellation of air tickets, airline fare rules and relevant bodies such as IATA (International Air Transport Association) will be apply. In the case of charter cancellations, the intervening operator clauses will be apply.
  • KAISHI TRAVEL Tour Operator, reserves the right to change the itinerary, transportation and likewise, to change the hotel for one of equal or upgraded category, prior noticing the passenger or its representatives, should circumstances require so, in order to provide the best services to travelers.
  • KAISHI TRAVEL Tour Operator, reserves the right to remove from the tour any person who may jeopardize or may incurred in any conduct that endangers the success of the plan due to serious moral or disciplinary causes, and will be reimbursed the value for services not taken, after having made the discounts described in paragraph 2.
  • KAISHI TRAVEL Tour Operator, disclaims any liability to any legal aspects or any other constraints that the user may be involved, if the user is force to interrupt the journey for these reasons. Also, disclaim any liability, against personal expenses the passenger may incurred.
  • KAISHI TRAVEL Tour Operator, will advise on the necessary travel documents but does not assume any liability for expenses, information, pickup and/or rejection of visas. Passenger will be fully responsible to submit all documents required by the embassies.
  • Should any loss or baggage robbery/damage occurs within the use of any land, river or sea transportation, agency expressly disclaims any liability for any circumstance. We recommend passengers to witness handling, loading/unloading process. If air transportation is used IATA regulations will be apply.
  • With regards to the land portion to the Alta Guajira, if vehicle gets stock on the dessert, and delays the arrival to the airport and the passengers lose their flight, KAISHI TRAVEL will not be responsible of paying any penalties charged by the Airline, nor any accommodation or meal costs.
  • Cost of the trip varies depending on the chosen routes by the passenger, type of means of transportation, local or rural accommodation, which will be define at the time of booking, however he/she may take any additional services with its respective charge.
  • At time of reservation a deposit of 50% of the total amount is required. 20 days before the trip start the remaining 50% of the cost need to be paid. Prices are based on current rates and they are subject to be modified without notice.

Cancellation Penalties

  • Cancellations made after booking originate 10% of the total amount of the circuit.
  • Cancellations submitted between 10 and 15 days before the starting date of the trip originate 25% of the total amount of the circuit.
  • Cancellations produced 5-9 days before the starting date of the trip originate 40% of the total amount of the circuit.
  • Cancellations made up to 2 days before the starting date of the trip originate 80% of the total amount of circuit.
  • No show result in a 100% of the total amount of the circuit.
  • Such refunds will be processed through the selling service provider at the end of the trip.

Clarifications

  • Porter services, when included in the program are provided by service operators at airports and other places of embarkation. Hotels have their own staff tor this purpose.
  • Check-in time at airports are established by international Airline regulations.
  • Passenger may request to acquire a travel insurance policy that covers aspects such as loss, theft or damage of his/her personal effects.

Physical Requerimients

  • Healthy physical conditions within normal limits. Health services (hospitals) present in Uribia, Maicao and Nazaret, and health posts (nurseries) in Puerto Lopez, Puerto Estrella and Cabo de la Vela.

Recommendations

  • Take yellow fever vaccination.
  • Take Thiamine (B complex) eight days before the trip to avoid mosquitoes.
  • Take this with you for personal use: Water Bottle, knife, toilet paper, toothbrush, towel, soap and toothpaste (preferably biodegradable).
  • Comfortable hiking shoes
  • Sandals or beach shoes
  • 2 sets of clothes for warm weather
  • Tee Shirts, shirts, pants, bathing suits and shorts
  • Flashlight with extra batteries
  • Sunscreen, Insect repellent
  • Sunglasses with UV filter

  • Personal first aid kid, Camera.
  • Sleeping Bag, Thermic Isolator long sleeve pajama or a sheet (as light baggage as possible).
  • The area we will visit is semi-desert, so this tell us that nights can be cold especially at dawn.
